The NASCAR Foundation will not sell, share or trade any names or personal information collected through The NASCAR Foundation website, mailings, or any other means controlled by The NASCAR Foundation with any other entity, unless required by the law.
What Personally Identifiable Information Is Collected
The NASCAR Foundation donors, subscribers and event attendees voluntarily provide us with contact information (such as name, e-mail address, zip code, etc.). We may use this information for specific, limited purposes. You may always opt out, either now or at any time in the future, if you do not wish to continue receiving our communications.
Information That Is Passively Or Automatically Collected
We, and our service providers and advertising partners, which include advertising networks and platforms, agencies, analytics/reporting vendors, platform and infrastructure monitoring vendors, and cloud service providers, use automated means to collect various types of information about you, your computer or other device used to access NASCARFoundation.org. A representative, non-exhaustive list of the types of automatically collected information may include:
- network or Internet protocol address and type of browser you are using (e.g., Chrome, Safari, Firefox, Internet Explorer).
- the type of operating system you are using (e.g., Microsoft Windows or Mac OS).
- the name of your Internet service provider (e.g., Comcast, Verizon, or AT&T) and domains used by such providers.
- mobile network.
- device identifiers (e.g., Apple IDFA, Android Advertising ID, or Adobe ECID).

- which NASCAR Foundation website you have visited and which sites you visited before and after you visit NASCARFoundation.org.

- your location information, which may include precise geolocation information when you have consented to the collection of this information in connection with the use of the wayfinding features in our mobile apps.
- the audio, video, or other content and advertisements you have accessed, seen, forwarded, and/or clicked on (such as via web beacons/pixels as further discussed below).
- last activity date and content views.
- your preferences, such as your favorite driver and favorite track.
- information about how you use NASCARFoundation.org (collected via tracking tools), including the buttons or parts NASCARFoundation.org you interact with using keystrokes, movements, clicks, and the pages you visit, whether you are a new or repeat visitor, your acceptance of our terms and policies, your interactions with our emails and other marketing materials, and other records of events that take place when you engage with NASCARFoundation.org.

How Your Information May Be Used
The NASCAR Foundation uses your personal information to provide you with personalized service, to send e-mails to you regarding our services or important updates, to answer your requests, etc. You may choose to opt out at any time, from receiving communications from us. We may also use your information to track visitors to our website. This allows us to evaluate the popularity of certain pages and tools so that we can better serve our followers. It also allows us to provide aggregate data about our followers (not identifying individuals, but showing how many users visited which pages, for example) to outside parties. Your personally identifiable information is never disclosed to third parties without your consent. Please keep in mind that certain areas of our website may be public, and that any information posted in such areas may be viewable and usable by anyone that has access to the site. We retain your information for the period necessary to fulfill the legitimate business purposes or uses outlined in this Privacy Notice unless a longer retention period is required or allowed by applicable data protection law or to otherwise fulfill a legal obligation.

We use cookies and other common tracking technologies both to provide our services to you and to serve personalized advertising to you. These technologies may also be used to analyze how our users interact with advertising on NASCARFoundation.org and elsewhere, and more generally, to learn more about our users and what services or offers you might prefer to receive. We describe some of these technologies below, as well as your choices related to these tracking technologies.
Cookies. We use “cookies”, “web beacons” or other common tracking technologies. Cookies are text files placed in your computer’s browser to store your preferences.
We, and our Service Providers, Advertising Partners, and Brand Partners, use cookies or other common tracking technologies to understand and analyze your interactions with NASCARFoundation.org, including ads on NASCARFoundation.org, and to improve or customize the products, content, offerings, services or advertisements on NASCARFoundation.org. For example, we may use cookies to personalize your experience on NASCARFoundation.org (e.g., to recognize you by name when you return to NASCARFoundation.org).
We, and our Service Providers, Advertising Partners, and Brand Partners, use cookies or other common tracking technologies to offer you products, content, offerings, or services that may be of interest to you and to deliver relevant advertising based on your interests on NASCARFoundation.org, an affiliate’s website, or third-party websites or applications that you visit.
We, and our Advertising Partners, and Brand Partners, use cookies or other common tracking technologies to manage and measure the performance of advertisements displayed on or delivered by or through NASCARFoundation.org and/or other networks or websites. This also helps us, as well as our Advertising Partners, provide more relevant advertising to you. One such Advertising Partner we use is Google Adwords. This service allows us to serve our advertisements on websites across the Internet. You may opt out of this feature using the Ads Preferences Manager.
Synching Cookies and Identifiers. We may work with our Advertising Partners (for instance, third party ad platforms) to synchronize unique, anonymous identifiers (such as those associated with cookies) to match their uniquely coded user identifiers to our own. We may do this, for instance, to enhance data points about a particular unique browser or device and thus enable us or others to send ads that are more relevant, match users to their likely product interests, or better synchronize, cap, or optimize advertising.
Locally Stored Objects. NASCARFoundation.org may employ locally stored objects (“LSOs”) and other client side storage tracking technologies in certain situations where they help to provide a better user experience, such as to remember your settings, preferences and usage, similar to browser cookies, or in order to target or help our Brand Partners target ads, analyze ads performance, or perform user, website or market analytics. For LSOs utilized by Adobe Flash you can access your Flash management tools from Adobe’s website. In addition, some, but not all browsers, provide the ability to remove LSOs, sometimes within cookie and privacy settings.
Disabling Cookies. Most web browsers are set up to accept cookies. You may be able to set your browser to warn you before accepting certain cookies or to refuse certain cookies. However, if you disable the use of cookies in your web browser, some features of NASCARFoundation.org may be difficult to use or inoperable.
We may collaborate with companies that use techniques other than HTTP cookies to recognize your computer or device and/or to collect and record information about your web surfing activity, including those integrated with NASCARFoundation.org. Please keep in mind that your web browser may not permit you to block the use of these techniques, and those browser settings that block conventional cookies may have no effect on such techniques. Web Beacons/Pixels. We may also use “web beacons,” also known as pixel tags or clear GIFs, or similar technologies, which are small pieces of code placed on a web page or in an email, to monitor the behavior and collect data about the visitors viewing a web page or email from us. For example, web beacons may provide information to us about your activity on NASCARFoundation.org (e.g., pages visited, links clicked, videos watched), as well as to count the users who visit a web page or to deliver a cookie to the browser of a visitor viewing that page. We may also use web beacons to provide us with information on the effectiveness of our email campaigns (e.g., open rates, clicks, forwards, etc.).
Mobile Device Identifiers and SDKs. We may use, or partner with publishers, publisher-facing or app developer platforms that use Software Development Kits (“SDKs”), to collect Information, such as mobile identifiers (e.g., IDFAs and Android Advertising IDs), and Information connected to how mobile devices interact with NASCARFoundation.org. A mobile SDK is the mobile app version of a web beacon (see “Web Beacons” above). The SDK is a bit of computer code that app developers can include in their apps to enable ads to be shown, data to be collected, and related services or analytics to be performed. We may use this technology to deliver or help our Advertising Partners and Brand Partners deliver certain tailored advertising through mobile applications and browsers based on information associated with your mobile device. If you’d like to opt-out from having ads tailored to you in this way on your mobile device, please follow the instructions in Opting Out: Your Ad Choices.
Third parties may themselves set and access their own tracking technologies when you visit NASCARFoundation.org, and they may have access to information about you and your online activities over time and across different devices, websites, or applications.
Sometimes, we may associate cookies with the Information, including hashed or masked versions of Information you have provided (such as during registration), to send or help our Advertising Partners send ads and offers based on your presumed interests or demographic information.

The tools provided on the DAA opt-out page, the EDAA site, and the Ad Choices Canada site are provided by third parties, not by us. We do not control or operate these tools or the choices that advertisers and others provide through these tools.
PLEASE NOTE: Certain choices you make through these platforms may be browser-specific or device-specific. If you erase or otherwise alter your browser’s cookie file (including upgrading certain browsers), or use a new or different computer, you may need to opt out again.
Opting out via this method does not prevent the use of cookies or similar tracking tools that are necessary for the operation of NASCARFoundation.org or other legitimate purposes unrelated to serving interest-based ads. Information may still be collected about your web browsing activities for these other purposes. While you will not receive ads based on your interests derived from your online behavior, you will still see advertising, including contextual ads that are based on the content of NASCARFoundation.org pages you visit.
We sometimes utilize Adobe technology to customize advertising you may see on NASCARFoundation.org or third-party websites. These “flash cookies” cannot be controlled through browser settings, but you can opt out of the receipt of targeted advertising utilizing Adobe technology by clicking here.
When using a mobile application, you may receive tailored in-application advertisements. Depending on your device, you may be able to reset your mobile device’s advertising identifier at any time by accessing the privacy settings on your mobile device. In addition, each operating system (iOS for Apple phones, Android for Android devices and Windows for Microsoft devices) provides its own instructions on how to prevent the delivery of tailored in-application advertisements. You may review support materials and/or the privacy settings for the respective operating systems to opt-out of tailored in-application advertisements. For any other devices and/or operating systems, please visit the privacy settings for the applicable device or contact the applicable platform operator.
The NASCAR Foundation emails, communications and website may include links to external websites. These links do not fall under The NASCAR Foundation control, and The NASCAR Foundation is not responsible for the content or privacy practices of external websites or organizations. This Privacy Notice does not apply to any information collected by third-party websites. You should consult the other websites’ privacy notices. Your use of any links is solely at your own risk. From time to time, we enhance the information we collect from you with other information that we obtain from third-party sources.
Other Important Privacy Considerations
Our site is not intended for the independent use of children, and we will not knowingly collect information for any child under the age of thirteen. We do not knowingly “sell” or “share” for targeted advertising the information of minors under 17 years old. If you are the parent of a child and have a concern regarding your child’s information on our site, please contact us at [email protected]. Our website and associated services are hosted in the United States. Even if you are outside the United States, your information will be processed and stored in the United States, and you are consenting to such processing and storage.
We have put in place technical, organizational, and administrative procedures designed to help prevent unauthorized access to or use of your information, and to maintain the security of NASCARFoundation.org and the information. These safeguards vary based on the sensitivity of the information that we collect and store.

What Are Your Rights and Choices?
Your right to make informed decisions about information collection is important to us.
Opting Out of Marketing Communications. Please note that you always have the right to opt out of having your Information shared with third parties for their own marketing purposes. To stop receiving advertising e-mails, follow the “unsubscribe” instructions in any advertising e-mail we send you (you will still receive transactional e-mails). To stop receiving text messages, reply “STOP” to any message.
If you would like to opt out from our sharing of your Information with unaffiliated third parties for the third parties’ direct marketing purposes please submit your request to our privacy portal.
Deletion of Information: You have the right to request that we delete the Information we have collected about you. If you would like us to delete Information about you, please submit your request to our privacy portal.

If you are a resident in Brazil, you have certain rights regarding information we hold about you. See below a summary of these rights:
- Confirmation of the existence of the processing. You have the right to ask us whether we process information about you.

- Complaints. You have the right to file a complaint about data privacy matters to the Brazilian Data Protection Authority (“ANPD”), or with the relevant regulatory data protection body in your country of residence. Before doing so, please tell us your concerns so that we can try to solve them.
If you are a resident of certain states in the U.S., you have the following rights regarding your information (subject to certain exemptions):
- Right to Know. You have the right to request that we disclose the categories of information we collected about you, the categories of sources from which we collected the information, the categories of information that we sold or disclosed, our business or commercial purpose for collecting and selling your information, the categories of third parties with whom we shared your information, and the specific pieces of information we collected about you. In some states, you also have the right to receive information on the categories of third parties or specific third parties with whom we might share your information.
- Right to Correct. You have the right to request in certain circumstances that we correct any inaccurate information that we have collected directly from you.
- Right to Delete. You have the right to request that we delete the information we have collected about you.
- Right of Data Portability. You have the right to request a portable copy of your information, to extent technically feasible, in a readily accessible format.
- Right to Opt-Out of the Sale or Sharing of your Information for Targeted or Cross-Contextual Behavioral Advertising. As described above, we sell or share the following Information with our Brand Partners and Advertising Partners so that we and/or our Brand Partners and Advertising Partners can deliver targeted ads and other tailored communications to you: Name, Contact Information, and Other Identifiers; Internet and Network Information; and Profiles and Inferences. If you would like to exercise your right to opt-out of targeted advertising, as well as the sale/sharing of your Information, please visit our privacy portal.
We also honor the Global Privacy Control, a browser-based opt-out signal. We do not respond to other browser-based signals that do not meet applicable state law requirements, which may include older Do Not Track signals.
- Right to Appeal: You have the right to appeal our denial of any request you make under this section.
- Non-Discrimination. You have the right not to be discriminated against for exercising the rights above.
We do not use your sensitive information outside of the purpose for which you provided it to us.
California Privacy Rights
Shine the Light Rights. You have the right to request and obtain from us, once a year and free of charge, a list of the third parties to whom we have disclosed certain types of personal information (if any) for their direct marketing purposes in the prior calendar year. At our option, we may respond to such requests by providing instructions about how our users can exercise their options to prevent our disclosure of personal information to third parties for their direct marketing purposes.
Please note that if you are in the United Kingdom or the European Economic Area, you also have additional rights. The GDPR (or the UK GDPR) provides the following additional rights to users located in the EEA, Switzerland, and the UK (each subject to the limitations set forth in the applicable law):

With the purpose of protecting our privacy and the privacy of others, you may be required to prove your identity before we take any measure to respond to your request. If a third party makes a request on your behalf, we will request them to prove that they are authorized to do so.
We may contact you to request further information and help you exercise your legal rights, or to accelerate our response. We will let you know in case we need more time, for example, if your request is complex. We may have an overriding lawful basis for processing your information, or certain exemptions may apply. We collect and receive information from inside and outside of the United States.
If you are located in the European Economic Area (“EEA”), United Kingdom (“UK”) or elsewhere outside of the United States, please be aware that information we collect is processed in the United States and other applicable territories in which the privacy laws may not be as comprehensive as or equivalent to those in the country where you reside and/or are a citizen. We put safeguards in place to protect your information when we process it outside of the country from which it was collected.
Users located in the EEA and UK: The companies with whom we share your information may be located outside the EEA and UK, and the processing of your information may involve the transfer of data to places outside the EEA and UK. Our agreements with companies located outside of the EEA and UK include standard contractual clauses that are approved by the EU Commission and otherwise make clear the standards that we expect from them in order to protect your information and legal rights. You have the right to receive a copy of the standard contractual clauses.
Users located in Brazil: Third parties with whom we share your data may be located outside of Brazil, and the processing of your information may involve the transfer of data to places outside Brazil. Our agreements with third parties include standard or specific data protection contractual clauses and otherwise make clear the standards that we expect from them to protect your information and legal rights.
Legal Basis For Processing Information
The legal basis for our processing of your information is generally because: (a) you have consented to our processing of such information, (b) it is necessary for us to perform our contractual obligations, (c) it is necessary for us to comply with legal and/or regulatory requirements and/or (d) it is in our legitimate interests (e.g., we may use information for marketing, sales and customer service activities, to improve NASCARFoundation.org and to support our IT security efforts).
